Terms of Service

Service terms.

Effective June 23, 2026. By submitting a sample to Charter Bioanalytics, you agree to these terms.

1. Service description

Charter Bioanalytics, LLC ("Charter") provides analytical chemistry services on client-submitted samples per the service tiers and methods described at /services and /methods. Charter does not guarantee any specific result — Charter guarantees the methodology and reporting integrity.

2. Sample ownership and disposal

Title to submitted samples remains with the client. Charter retains a 3 mg minimum retain for 1 year for re-analysis purposes, then destroys per SOP-070. Clients may request return of the retain within 30 days of report delivery for a $35 return-shipping fee.

3. Payment terms

Payment is due upon report delivery via Stripe or invoice (Net 30 for approved accounts). Reports for unpaid samples may be withheld pending payment. Wholesale and volume terms per separate written agreement.

4. Report ownership and use

Reports are owned by the client and may be shared with the client's customers, suppliers, or partners. Charter retains the right to reference aggregate statistics (without identifying individual clients or samples) in marketing materials and public communications.

5. Limitation of liability

To the maximum extent permitted by law, Charter's liability for any claim arising from a service is limited to the price paid for that service. Charter is not liable for any indirect, consequential, special, or punitive damages, including business losses arising from a report result.

6. Quality disputes

If you believe a Charter result is in error, contact support@charterbioanalytics.com within 30 days of report delivery. Charter will open an OOS investigation per SOP-050 and respond within 10 business days.

7. Confidentiality

Sample identity, submitter information, and report contents are confidential and shared only as described in our Privacy Policy.

8. No therapeutic claim

Charter analytical reports describe the composition of submitted samples. Reports are not, and shall not be construed as, FDA approval, clinical recommendation, or endorsement of any compound for human or animal use. Compounds tested are research chemicals.

9. Governing law

These Terms are governed by the laws of the State of New Mexico, USA. Disputes shall be resolved in New Mexico state or federal courts.
